Design
The unregistered design can be protected by copyright
Regulation (EC) No. 6 / 2002 of 12 December 2001 on Community designs, provides protection for any designwhether registered or unregistered. The right to the Community design belongs to its author or his successor in title.
For the purposes of regulation, the term:
a) Design: the appearance of the whole or part of a product resulting from the special features, includingcontours, color, shape, texture or materials of the product itself or its ornamentation.
So can differentiate two aspects of the birth of the work as such, can generate evidence relevant authoring via intellectual property rights, and a second aspect, as registered industrial protection gives the owner the exclusive right to use and prohibit its use by others without their consent. The afore mentioned use in particular manufacturing, offering, putting on the market, importing, exporting or using of a product incorporating such a design or to which it is applied, and stocking such product for those purposes.
